If you do not provide us with your personal information we may be unable to respond to you, provide you with requested products or services or information about them, or tailor the content of our websites to your preferences.

We may disclose your personal information to:

  • our employees, related bodies corporate, contractors or service providers for the purposes of operating of our business or website, fulfilling requests by you or to provide products and services to you;

Fulton Hogan (Fulton Hogan Ltd and its subsidiary companies) values the privacy of individuals and are committed to safeguarding information it receives in connection with its diverse range of activities.

To achieve this commitment to privacy, Fulton Hogan will comply with the New Zealand Privacy Act 2020 and its amendments (the Act), and the Information Privacy Principles (IPPs) set out in the Act. This policy outlines how Fulton Hogan collects, uses and manages personal information about an individual from both internal and external sources.

Fulton Hogan may use personal information for direct marketing or to advise an individual about new services and marketing initiatives that may be of interest to them.

These communications may be sent in various forms, such as mail, SMS, fax and email, in accordance with applicable laws. By submitting your personal information to us, you consent to us using your personal information for direct marketing purposes. Any direct marketing material will include a notice allowing you to nominate if you do not wish to receive further direct marketing communications.

3. Information collected via our website

To ensure we are meeting the needs and requirements of our website users, and to develop our online services, we may collect aggregated information by using cookies. Cookies are unique identification numbers like tags that are placed on the browser of our website users. The cookies do not in themselves identify users personally, but are linked back to a database record about them.

We may use cookies to track use of our website, and to compile statistics on visits to the site in an aggregated form and log anonymous information such as:

  • a user’s top level domain (such as .com or .nz);

When a user visits our site a cookie may be placed on their machine. Where a user has visited us before, the cookie may be read each time they re-visit the site. We do not use this technology to access any other personal information of a user in our records and a user cannot be personally identified from a cookie.

4. How will Fulton Hogan store and manage your data?

Fulton Hogan cannot guarantee that the internet or emailing is a secure means of submitting personal information. From time to time, personal information may be held in the cloud or overseas databases in countries such as Australia, the United States or Singapore. We will take reasonable steps to protect the personal information we hold from misuse and loss, interference and from unauthorised access, modification or disclosure.

Fulton Hogan will securely de-identify or dispose of personal information when we have no further need to use it, or when we are required by law to do so.

5. Email Security

In accordance with our email policy, any emails you send will be automatically scanned which may result in your email or attachments being blocked. Our IT administrators may have access to your emails to authorise the content for security purposes only and not thereafter.

6. How can I access and correct information?

You may request access to personal information that we hold about you. Fulton Hogan will provide you with access to personal information in accordance with the Act and IPPs. There may be instances where we cannot grant you access to the personal information that we hold; for example, if it would interfere with the privacy of others or if would result in breach of confidentiality. If you are refused access to information, we will provide you with reasons for the refusal and inform you of any exceptions relied upon under the IPPs.

Fulton Hogan will take reasonable steps to make sure that the personal information we collect, use or disclose is accurate, complete and up-to-date. If you believe that the personal information we hold about you is inaccurate or out of date, please let us know and request us to amend it. We will consider you request, and if we are satisfied with your request we will take reasonable steps to correct the information. If we do not agree that there are grounds for amendments, then we will follow the procedures set out in the IPPs.

All requests for access to personal information must be made in writing to Fulton Hogan. A reasonable fee may be charged by us for the cost of verifying the application and location, retrieving and copying the information requested. We will not charge you for simply making the request.

7. Changes to this Policy

We may update or change this policy. When we do so, we will publish the current policy on our website. Please check our website to review this policy regularly.

We may need you to provide more information about your concern. If your concern is bona-fide, we will investigate the issue and endeavour to provide you with a written response within 28 days of receipt of your written query. Sometimes we might not be able to provide you with a written response within the timeframe specified. If that is the case, we will contact you and explain the reason for the delay and give you a new timeframe for a written response.

If you are not satisfied with our response, please notify the Privacy Officer in writing. We can escalate your matter and review the response that you were given. This may involve an escalation to the next level of management or referral to a member of our dispute resolution team. You are entitled to make an anonymous complaint or inquiry in relation this privacy policy, the IPPs or your privacy rights. However, we may require you to identify yourself if required by law or if it is impracticable for Fulton Hogan to deal with your matter otherwise.

Fulton Hogan – Privacy Policy – Mobile Applications

This Privacy Policy (Policy) describes how Fulton Hogan collects, holds, uses and discloses your personal information, and how we maintain the quality and security of your personal information when you use an application developed by or for Fulton Hogan (App).
Fulton Hogan values and respects the privacy of the people we deal with. Fulton Hogan is committed to protecting your privacy and complying with:

  • the Australian Privacy Act 1988 (Cth);
  • the New Zealand Privacy Act 2020; and
  • other applicable Australian and New Zealand privacy laws and regulations.

In this Policy, personal information has the meaning defined in the Privacy Act 2020, and Fulton Hogan (and we, us, our) means either Fulton Hogan Limited (in New Zealand) or Fulton Hogan Pty Limited (in Australia).
By accessing, registering to use, and/or using an App, or otherwise providing personal information to us, you consent to the collection and use of such information by us and our agents, in accordance with this Policy.

1. What personal information we collect

We collect personal information provided in connection with an App, including your name and email address, and (where relevant) your employer, mailing or street address, date of birth, and phone number. In addition, some Apps may collect other personal information, depending on the nature and purpose of the App.
In connection with your use of an App, you authorise us to collect personal information about you from your employer. Where you provide us with personal information regarding any other individual, you confirm that such individual has authorised you to provide this personal information to us for the purposes set out in this Policy.
If you do not provide any necessary personal information, you will not be able to use the relevant App.

2. How we collect your personal information

We may collect your personal information directly from you when you:

  • download, access, register to use and/or use an App;
  • interact with us over the phone, in person or online;
  • participate in surveys or questionnaires;
  • subscribe to one of our mailing lists or other communication mechanisms.

3. How we use your personal information

Personal information submitted to us via an App will be used for the purposes of providing, operating, supporting, and maintaining the relevant App, and for any other purpose specified in this Policy.

We may also use and disclose your personal information:

  • to provide you with information that you request from us;
  • to improve the quality of the Apps we offer;
  • for internal administrative purposes;
  • for marketing and research purposes;
  • for related purposes for which you would reasonably expect us to use or disclose the information;
  • where you have consented to us using or disclosing the information; or
  • where we are required or otherwise permitted to do so by law.

4. Disclosure of personal information to third parties

We may disclose your personal information to third parties for purposes reasonably connected with the purposes for which we may use your personal information. For example, we may disclose your personal information to:

  • your employer and/or colleagues in connection with the functions of the App;
  • our third party service providers (for example, our IT providers);
  • our marketing providers; or
  • our professional services advisors.

5. Transfer of personal information overseas

Some of the third-party service providers we disclose personal information to may be based in or have servers located outside of New Zealand or Australia.
Where we disclose your personal information to third parties overseas, we will take reasonable steps to ensure that data security and appropriate privacy practices are maintained. We will only disclose to overseas third parties if:

  • you have given us your consent to disclose personal information to that third party; or
  • we reasonably believe that:
    • the overseas recipient is subject to a law or binding scheme that is, overall, substantially similar to the New Zealand and Australian privacy principles; and
    • the law or binding scheme can be enforced; or
  • the third party is required to protect the personal information in a way that, overall, provides comparable safeguards to the New Zealand and Australian privacy principles; or
  • the disclosure is required or authorised by a New Zealand or Australian law or court / tribunal order.

6. How we protect your personal information

We will take reasonable steps to ensure that the personal information that we hold about you is kept secure, including by:

  • having robust physical security of our premises and databases / records;
  • taking measures to restrict access to only personnel who need access to that personal information to provide services to you; and
  • having technological measures in place (for example, anti-virus software, fire walls, etc).

Of course, data transmission over the Internet is inherently insecure, and we cannot guarantee the security of all data sent over the Internet.

7. Data breach notification

In the event we become aware that personal information we hold about you has been lost or subject to unauthorised access, misuse, interference, or disclosure, we will take steps to contain and rectify the data breach, as soon as practicable, prevent reoccurrence, and comply with any applicable notification obligations.

8. Retention of personal information

We will not keep your personal information for longer than we need to. In most cases, this means that we will only retain your personal information for the duration of your relationship with us unless we are required to retain your personal information to comply with applicable laws, for example record-keeping obligations.

9. How to access and correct your personal information

We will endeavour to keep your personal information accurate, complete, and up to date. It is your responsibility to let us know if the personal information we hold about you needs to be corrected or updated.
If you wish to make a request to access, update and / or correct the personal information we hold about you, you should make a request by contacting us in writing. We will use reasonable endeavours to provide, update and/or correct this personal information as soon as reasonably practicable.

10. Links to third party services

An App may contain links to services provided by third parties. If you access a third party service through an App, personal information may be collected by that third party service. We make no representations or warranties in relation to the privacy practices of any third party provider or service and we are not responsible for the privacy policies or the content of any third party service. Third party providers / services are responsible for informing you about their own privacy practices and we encourage you to read their privacy policies.

11. Inquiries and complaints

For complaints about how we handle, processes, or manages your personal information, please contact our Privacy Officer at PrivacyHelp@fultonhogan.com. Note we may require proof of your identity and full details of your request before we can process your complaint.
Our Privacy Officer will investigate any questions or complaints that are received and respond to you as soon as possible. If you are not satisfied with our response to a complaint, you have the right to contact the following organisations to raise a compliant:

  • In Australia: The Office of Australian Information Commissioner (at www.oaic.gov.au/); and
  • In New Zealand: The office of the New Zealand Privacy Commissioner (at www.privacy.org.nz/).

12. Changes to this Policy

We may update this Policy from time-to-time by posting a new version on our website. Any change we make applies from the date we post it on the website.
